No he doesn't have pending GC status.His wife is on 4th year of H1 and she already got EAD.But her priority date is not current (Sept 06)to add him to her GC status immediately.

Hi,
I have my labor certiifcation approved and currently filed for I-140.
I-140 is not approved yet.
I have an offer from another employer with very similar job profile.
My 6 yrs of H1 is getting over in 2010 summer.
My prioriy date is Dec/07.
What are my options
1) Can i change a job and keep same priority date(as job profile is very similar)
2) Do I have to start from zero again?If yes,how much time I have to get priority date assigned again(considering my H1 bgets over in 2010 summer?)
I will appreciate your comments

USCIS has announced that it is working on a rule to create an electronic registration system for H-1B employers subject to the annual cap. Employers would first register an application and be allocated an H-1B cap number and then would file the case. The idea is that employers would need to register to claim an H-1B cap number first and then if they are selected, they then would prepare and file the case. I have B1/B2 Visa for 10 yrs and travelled to USA earlier and also planning to VISIT USA on B1/B2 Visa in the last week of July for just 10 days.
The doubt is that - "since I have H1B Visa CASE APPROVAL, can I travel to USA on B1/B2 Visa"
Someone suggested that I can travel but it is NOT ADVISABLE!!

The AC21 determination of whether a new job is in "the same or similar occupation" is made based on a comparison of the new job duties and those set forth on the original labor certification application. Job titles are not controlling. So, you need to have a copy of your original LC application and then compare the job description it contains to the duties of the new position.

It is advisable to file change of status to h4 while in USA, no need to go back to India. After you get your h4 approved then you can go for stamping...
That is good approach, if
1. one is maintaining status at the time of H-4 Change of status application
AND
2. Person is not traveling out of USA in short term future

For those of you who already went through this process,can you please advise what are the chances for someone in Hungary to immigrate to US on a H1B visa?
The person I'm talking about is Hungarian, has an MBA from a Hungarian University (BA in Management), 5 years professional experience within multi-national companies (currently employed by one). Although he is trying to move to US through L1 he's also interested in the H1 path for a different company.
What are currently the chances for H1B and what is the best way of finding a sponsor?

This Skil bill in HR development looks very exciting....may be this will be the our savior bill. Now senate and house both has similar bills and based upon the trend, it looks there is not much resistance to this new bill.
I hope with in few weeks we, the retrogression sufferers will be out of the dodge.

Last month dates were 7 Jan 2005.
This month dates are 22 Jan 2005.
Still the reported Jan 2005 approvals(, IV ) etc are less than 5.
Not sure whats happening to these
