The following news items suggest there would be a serious attempt to pass CIR early in 2009 in both the houses of congress. That makes DC rally really more important as we just cannot afford to let even a single Durbin/Grassley provision to slip into CIR.

I guess no complications unless USCIS asks for employment verification at the time of approving the case. He should continue to file for Income tax retrun for 2010 and also need to work for few months in 2011 to file for return.

My wife came to the US on a H4. She got her H1 approval in October 07 and started working for the consulting firm that sponsered the H1. She also got a consulting position in a company. But her SSN was not issued until Jan 08. So the consulting company cannot gerenate payroll for Oct, Nov and Dec of 2007. We are planning to goto India in May and also get our Visas stamped. Any ideas on whether we will run into problems when we go for stamping, since she will not have a W2 for 07. Also will the paystubs from 2008 suffice at the consulate? Do we have to tell the consulate that she started working in Oct 07 or can we just say she started in Jan 08 will this create a problem of why did she not strat working as soon as her petition was approved in 07.

A little out of the box thinking. There are some useful ideas here even if there are many practical questions on how the plan would work. For one, is a highest bidder system necessarily the best indicator of which employers are most deserving of securing visas. Should a school system desperate for math teachers lose out on securing a visa just because it has a much more limited budget than a major corporation? I'd suggest perhaps looking at a program like this running as a separate track in the immigration system rather than necessarily replacing what we have. Of course,...

I am married with an American Citizen. His petition has been approved. My problem is that I cant change my status because my J1 visa was subject to the 2 years home country. I came as an Au Pair or Child Care Provider in 2007. I have been subject to that rule because the Skill List from 1997, which is not even in any field in my country El Salvador in the Skill List. That is why my application is hereby denied.
I dont know what i should do, because just I have 15 days to make a motions to reopen o pay a waiver and re-file my application all over again.
Please I need help is anyone can advice me in this. I really need it.

Does anyone have an idea about CP.
1. My 140 is filed and pending. I did not go through premium
2. How to get the CP appointment?
3. Since we dont file 485 if we prefer CP, what happens if the visa dates retrogress,but you have a CP appointment?
4. Is there a way to secure something in CP while the dates are current. ie, in AOS, just filing is enough to avoid several hassles. Is there anything like this in CP.

This incident opened my eyes and prodded me to move my fat ass to do something about this.
I just made my first contribution of $100 to IV.
Gandhi once said "Make your contribution, however insignificant you think it is. In reality, your contribution makes a huge difference".
Like he said, our little acts when combined become a formidable act and can accomplish a lot. I would suggest others make contributions too - especially now when everyone is excited - before you get back to the usual reticent state. let us not try to ride piggyback on some else's efforts.

I become a us citizen a couple of years ago. i was able to sponsor my brother to get an F1 visa. He will get a master degree in computer engineering in a couple of years. I would like him to stay in the us to work and live. i am thinking about filing an INS form I-130, Petition for Alien Relative. how the filing of i130 affect his non-immigration f1 status? what is his chances to get an h1 visa while he wait for the immigrant visa number (over 10 years)? can he go back to visit the family and reenter the us without an issue?

Hi,
I have I-140 approved(ABC company) and have 5 months left in my first 6 year cycle. I was laid off from the job. A New employer XYZ applied for my H1B extension based on I-140 approval and got approved for 3 years.But I was unable to join
XYZ due to family situation and moved back to India.
Questions:
1. Can a new employer apply for H1B extension based on my I-140 approval even though I am not in USA.? My I-140 has not been revoked or cancelled.
or
2.Can I claim the remaining time on my H1B approval(based on I-140) with company XYZ ?I have copy of the H1B approval but not sure if it has been revoked.
Please advice.

I had a robbery case in the U.S. in 1995 and was sentenced to 9 years with 85%. Later, I was picked up by immigration and deported for the case in question. While I was in immigration jail I fought my case and won it but immigration appealed it on the first court. I decided to return voluntarily to my country instead of fighting my case over. Now I want to return home in the U.S.. I want to know how do I go about reopening my case.

So I was one of the lucky (yes a bit of sarcasm) people that got transferred in July 2007 to be receipted in California even though we sent the papers to Nebraska. In Sept 2007 they told me they are now transferring my application to Nebraska. And guess what just today I got the update on CRIS that it is now pending at the Nebraska office.
What did they go on vacation for over a year or how can it take that long to transfer something that was never supposed to be transferred in the first place, because I did send it to the correct office, they just decided to move it because of receipting back ups.

I just wandering, how long would it takes get decision in I 485 after FP (background check Cleared)?
I just not make sense to me, that a lot of people file on May and June () are getting approval on September 17, 2007, but latest processing time in NSC for I 485 is December 21, 2006. If that case, my I 485 was filed on July 2, 2007, and it will got approve by the end of this year.
Can someone explain to me how this work or how USCIS make a decision for I 485?
