Diptam , its been repeatedly said CIR is not law yet , so dont think otherwise and be best wishes that it wont pass in current form. I hope there would be somthing as in case Law cant be retroactive. So cheerup and lets hope for the best.

No. it was talk about validating employment for legal immigrants at the workplace. I-9 etc... They just worded it as "Employment authorization"

Pappu - it is good to know that we are using the current mass media in this techie country (actually world...should say). Anything "Open" would yield good results.

Nice to see something other than economy down, GC crisis. How your wife manage to do all this. I have two sisters and both are working hard to feed their in law, even before marriage their mother in law asked for giving 20% money to her son (doctor), so he can study, arrange all facilities for him.
So I am really not understanding how your wife can do all this to you? My sister's shoul take lessons from her.

Though the denial of this MTR is against the law by USCIS, one must consider following.
AC21 is a benefit for a long delayed adjustment of status applicant to change the employer before getting GC. This law was framed based on the fact that the employee working for a long period of time with sponser (either in non-immigrant visa or in EAD) and cannot change the job because of prolonged delay in approval of 485. However, one must remember that, the fundamental priciple of granting GC is based on the fact that intent of the employee working "permanetly" or some longer period of time for the sponser. If the employer can demonstrate successfully to the USCIS that the employee does not having the intent then USCIS may deny the 485. If one resigns just immediatly after the 180 days, it doubts the legitimacy of the intent. If employer argues that the employee was waiting just for 180 days and using the law to change the job, there is a reason for USCIS to belive the employer's claim about false intent of the emploee. But one can overrule this denial in court, if the employee demonstrates that he/she worked for the sponsor for a considerable period of time before and after filing 485, to prove his/her intent.
I have also heard from some members on forums that the merit of the case is taken into consideration when such a decision has to be made.

That is not true, my lawyer who is very influential and he has some good contacts he told me that this year spill-over would be different form last year. I was stupid so didn�t believe him about July 2007, and paying it for now for not having EAD.
I know this is hard to believe especially if something comes from lawyer.

I congratulate everyone whoes PD becomes current beginning of next month. But be aware that all of this is no good until USCIS acts on it. USCIS has to match and increase their pace of processing I-140 & I-485s for people to benefit of this movement. There are thousands of people whose PD have been current since April of this year and still they see no movement on their cases. PD becoming current is just the first & crucial step in the this long process, but now it all depends on how well USCIS responds by processing cases in FIFO manner.

Hello everyone,
This is what I have done today. Called up BOTH my Senators and My local Congressperson. First asked them the name of the Person in-charge of immigration. Then Faxed him/her a ONE page description of what has happened and Urged them to take action.
Please do the same with your local Lawmakers. I believe that if Enough people call and fax them, they WILL do something eventually. It's a NUMBERS GAME and only if enough people contact them will they budge.
Please contact your lawmakers with a Nicely typed letter explaining your current situation and what the USCIS has done.

Any one recently re-financed or obtained a mortgage loan with Bank of America or Wells Fargo. Both the banks denied loan stating not having a valid visa as a reason, though I have approved EAD with 485 pending and I-140 approved. I have contacted the customer support, since the loan was through the mortgage broker. The underwrite appears to not accept EAD as a valid status and asking to provide a copy of visa to purse further. Any one have any specific docs / links that might help other than the ones in this thread.

Progress of PDs are similar the ones which happened prior to June 2007. May be there is a chance of repeating that now......

So if the pattern of last 2 years also holds this year, there will be slow month or 2 month movement until the last quarter (july/aug/sept) and then boom-bada-boom massive movement of maybe a couple of years. In that last quarter its all hit or miss, some 20-30% of people who get current will get GC (like what happened last year) then again back to 1 year of creep and crawl... hopefully by then we get some form of immigration legislation to clear this backlog.

Coming to ur note , I guess , people who apply from F1 to I-485 you are referring are not the primary green card applicants. They are dependents on primary applicatns. If not, can you tell me what they are studying and how they can apply green card from F1? I am not aware of this route.
Numerous students on F1 visa applied 485 and got their GC these years.
