    Just wanted to know your thoughts on this. CNN has launched the first ever cnn-youtube debate and the deadline to submit videos is 7/22.. Users have to basically upload their questions on youtube and some of these questions will be selected and democratic presidential candidates will have to answer these questions.

    I know its kinda late, but why not upload videos on youtube asking questions about legal immigration to the candidates? i think it will be a great way of bringing out our problems further in the mainstream... if you think this is a good idea, we may have to act on it fast... we dont have much time.

    May be yes....applying greencard is required to extend the H1...having said that one has to spend huge money in applying for GC...at the same time one can also stay out of US for an year and come back if required...

    I came to US when I was 24 years old...I delayed the filing and not a day goes by that I donot repent that...My friend are GC holders and bought their houses..I am 30 now..

    I think that even at your age..a GC is good to have....It opens up many possibilities....Whatever money you save doing a job...I doubt that you can go back and retire..The prices of everything keep going up in India...One still would need to work....

    Even if social security benefits get reduced in US, they would still pay something...In time if you have citizenship you can get whatever you can from that and whatever you saved would make a living...In fact if you donot have a concrete plan of returning in 1 year, file for GC immediately....

    When this organization is successful, you would at least have a 485 filed and your spouse can work and they would not throw you out summarily...

    If Substution labor was ethical, PD porting from EB3 to EB2 is ethical.
    Ithink PD Porting might be legal at this time but not ETHICAL.

    If substitution was unethical, July 07 out-of-turn PD flood which has created a HUGE backlog is unethical, if that is unethical, PD porting is also unethical.

    you are in fools paradise if you thing america is losing by delaying GC for us...in fact the more it delays the more it gains...

    a.) Obvious processing fess which runs into billions..
    b.) a whole industry of legal professionals who feed off legal and illegal immigrants ...what will happen to Murthys and khannas...and the collateral josb that have been created by immigrants
    c.) the Social security is being sustained by hi-tech and legal immigranst who pay their taxes on time.


    i can list many more..but then the purpose of your article will be lost!..;-)

    if you are asking for ideas on what is US losing..thats because they lose nothing...its only us who think that we are important for US..for them we are nothing but cattle from third world country!

    pardon my ignorance. But since you already applied for 485, it means you will get GC in april 2009(if pd becomes dec 2005) ?

    I, for one, am happy with this Oct visa bulletin. This is how it should be. First give GCs to all those with < 2003 PD. You guys with 2006 and 2007 pd should be glad you even got to file I-485 and EAD. What are you bitching about?.

    Some benefits can be revoked automatically (I-140, I-485), some can be revoked only after determination is made by USCIS and a beneficiary is notified and has an opportunity to respond. EAD is one of the latter.
    See e.g., 8 CFR Part 205 titled "Revocation of approval of petitions". It has two sections: 205.1 Automatic revocation and 205.2 Revocation on notice.

    EAD is not listed in Sec. 205.1. Moreover, 8 CFR �274a.12(c) specifically lists reasons for automatic revocation. I-485 denial is not listed as such a reason. Therefore, EAD remains valid even after I-485 denial untill it expires or until USCIS director revokes it. I do not see any basis for a different legal interpretation.

    See also this court of appeals (8th Cir.) decision where the court says that automatic revocation occurs only if a specific condition specified in the laws and regs is met:

See 8 U.S.C. � 1153(a)(1). In that case, Taylor may have been legally present throughout her time in the United States."

    Did you check the New I140 approval notice? The priority date on the latest I140 will have your Old PD. I believe its also advised you file an interfiling request.

    Thanks for your reply. I still have to find out from the lawyer. All I have heard from him is 140 is approved. Before filing 140 he did say alongwith 140 application he will send a interfile request. I checked my 485 application online there is no change in LUD.

    I am sorry for posting in here, but I was wondering if someone actually went in person to the Houston Consulate to get their passport renewed. Also, do we need to have any reason to attend in person at the Consulate such as emergency, etc.

    I am from India and my passport is expiring on Aug 17. I read before in the forum that it is better to go in person to renew the passport. Any experiences please let me know.

    I'm RN outside the US:cool:

    I will try to answer on your second question first. Shumer/Hutchinson amendment is the only our chanse for now. Try hammond law group, or shusterman, you will find info about it there. Shortly, it is the second try of Mr.Shumer and Ms. Hutchinson to amend an "Omnibous Bill" with a favorable for nurses and PT amendment. It would provide all schedule "A" with 61000 visas! If it is passed, we will be in chocolate:D , I mean you will get your GC in approximately 6-8 months (or a year). Nobody knows what are the chanses! My opinion that we have 50% that such a bill will be attached, and than we again have 50% that it will be passed and signed by Bush, before the end of the year.:rolleyes: If we are not lucky we would not see any favorable bills till after the elections of president and senate, late 2009(!).:mad:

    Under EB3(if no schedule "A", and there is no other favorable changes in immigration law),and you are from India, you will have to wait forewer (10 years or so)! But if you are in the US, and you will be able to file I485, DO IT!

    My advise is: file I140 as soon as possible, not sure about the avilability of premium processing, if you can, then use it also, if you can file I140 and I485 concurently - DO IT! I'm not familiar with procedures for PT, maybe you will find information here:

    thanks for all the info...i missed the july opportunity as my employer told me that filing I-140 would take atleast a month....including applying for labor ETA 9089 form,job posting etc....so i could not file I-140 before july 31st....and the august 17 deadline is not valid for me anymore...
    it seems difficult to comprehend that all PTsts and nurses coming to US from india wud now have to face 10 yrs of wait for GC especially with acute shortage of these professions here....i am sure some kind of bill or extra numbers would be given for these professions to speed up the process......in some states there is such an acute shortage for PTs that they are paying huge sign on bonus and pay package and the future demand is going to increase due to baby boomer generation retirement.....with h1 numbers going down to 65k for ordinary and only 20k for masters,i am sure there would be some steps taken to ensure getting more PTs and nurses from outside US in the future(2-3 years)......lets hope for the best n keep our fingers crossed.......

    I don't think what u wrote is possible.

    what is yoru priority date?

    Do u have an older PD or Is it Sept 2006 EB-3 india then how can u file for I-485 in June 2007 when your PD was not current??

    I think I have been very lucky so far. I don't think USCIS processes based on anything concrete, I think it's a little random. Or maybe I am just lucky.

    I applied for PERM in Sep 2006 - EB3 - India.
    I got approved for PERM in Mar 2007.

    I applied for I-140 and I-485 concurrently in Jun 2007.
    I-140 got approved July 20, 2007 and on July 23, 2007 I received all 4 receipts for I-140, I-485, EAD and AP. So my approval came before my receipt. I live in California so everything went to Nebraksa.

    Lawyers emailed saying they also received the EAD card yesterday July 23, 2007.

    Now I have to wait for only AP and Adjustment. And I still have 5 years left on my H1-B (2 years on this visa and then another extension).

    So I say, anything is possible. I wake up every morning and pray to USCIS because they made my life better :) :) :)

    Can you re-read the post and quote relevant parts of my very first post to prove that i was assertive?
    I very clearly said that this info was from customer rep and was true for NSC only.
    I have called USCIS twice for specific information because i need t0 travel to europe on a business trip in the months of sept/oct and was interested in getting AP.

    Information in this forum or any other forum is for sharing purposes. People should take that and do their own due dilligence.

    I have been on yahoo finance for the past 8 years and read many posters recommendation about a particular stock. Do you make investment decisions based on those posts?

    You need to update your skills about forums and the validity of its contents.
    No one can be assertive in their posts and not even the information originator or its source.
    So, please refrain from personal attacks.
    I know you and buddyinus are doing just that.
