My wife is laid off and her company is going to cancel her H1B soon. h1 petition is getting expired on Oct,2009. now I am going to apply for COS to h4. If she wants get H1 status after one year can she use the same petition for H1 transfer?. or she has to apply a new H1?.
Can you please help me.
She has to apply for COS again from H4 to H1. It will not be subjected to the cap if she had H1 within last six years at the tme applying COS to H1

I'm glad to see Immigration Voice weighing in on this one. Under some of the versions of health care reform proposals being considered by Congress, legal immigrants could be excluded for five years before they can access the Medicaid and insurance subsidies despite the fact that they pay taxes, are abiding by all of our laws and are often making critical contributions to the success of this country.

Hi,
I see a LOT of the same questions being posted over and over again. (eg. H1b Transfer, Eb3 to Eb2 etc). I also see that the Questions answered by the lawyer are quite hard to access and the info about the next call etc is also quite hard to get to.
How about we bring the 2 worlds together. We have a Menu Item on the Left saying either "FAQ's about immigration" or "Q/A from lawyers" etc. and somewhere on the homepage plus in the forums section we put some text saying "Before posting please check out the answers from lawyers" and put a link to the same.
Along with that (if possible), we also put all the questions and how many have been answered and which ones are going to be answered.

I have a approved I-360 (Batter Spouse Petition) and a pending I-485. However I got a letter in the mail stating the will revoke my 1-360 based on Section 204(a)(1) of the Immigration and nationality Act! It further states that I am not a person of Good Moral Character.
I was arrested in Belize my home country on November 19 2002 for Harm.Which would be Assault, and charged $100.00 and released.
This was not include in my initial application becausse it was outside the 3year period since my application was in 2007.
So I got the court documents and I am ready to submit it! but I am not sure if I shoudl seek legal advise or just submit the required document that they want!
They are asking for:
1.) Arrest Report.
2.)Copies of Cout documnet showing final disposition.
3.) relevan excerpts of the law for that jurisdiction showing Maximum possible penalty for each charge.
Please advise! is this something I should be feareful of?

1500 H-1Bs were claimed in the last week and just over 20,000 remain for the fiscal year. Based on a four week rolling average (1175), I am projecting the target will be exhausted in 17 weeks which will be February 23, 2011. If I-485 is filed improperly, the application can be rejected and we need to resend again, however if the date move back, we will be stuck for years again.
What are the basis on which USCIS will reject the application, when the lawyer apply the application, what kind of evidence we should be double checking in our side, so that we do not have any potential for rejection.
If the fees are correct, if the forms are signed, all the initial evidence is provided? These are good enough to guarantee the acceptance of application.

Hi,
H1 Company is based in Phoenix with another office in delaware.I have gievn my address from NewHampshire on my LCA and NJ on my I 140 application.I work for a client in Newyork.I have given my address in New hampshire as I was not sure that my project will be for a longterm and gave my cousins address in New Hampshire for LCA.
I got an RFE asking why I have different addresses on my LCA and I140 while my company is based out of Arizona and Delaware.Please suggest how I should be answering this.

My wife H1B was approved under Consular Processing. She got job offer now and it is a Consulting job to Hire. We applied COS at CSC by Premium processing. Reached application on Sep 28 and Status is Acceptance by then.
1 ) Everything is genuine and in the client letter it is mentioned as 6 Months contract to hire. Are there any posibbilities of getting H1B approved for only 6 months from now.
2 ) Are there any chances of rejection
3) Sincle past week it is under "Acceptance" stage. I know i have to be patient.
4) Can we expect some decision from them this week as client is waiting.
5) At what time CSC updates the case. Is there any particular time they update the case online.
