Of course the vote had to fail. Senate is Dem controlled and they are anti-legal presently. But the fact that it got voted down by a few votes should give us some optimism.

There is another thread on this same topic that presents a discussion on how the ammendment was not rejected per se, but it was more like including the ammendment that was rejected.
From the daily dairy (thomas.loc.gov):
"By 55 yeas to 40 nays..Senate rejected the motion .. with respect to Cornyn Amendment No. 2339 (to Amendment No. 2327), to provide interim relief .... Subsequently, the point of order that the amendment, was not germane, was sustained, and the amendment thus fell."

** what type of action are you talking about. Who has the money to hire another lawyer to fight against these people. The only action one could have taken is to leave the company. But as a matter of fact all the desi companies are the same.
If you are talking about getting hired by big companies then tell me seriously how many companies are willing to go through the paper work and file h1-b. During the 2001 recession tell me how many big companies were hiring.
A drawback of the big companies is that if your are fired you loose your gc process, if you are working for a consulting company you have option of consulting and your greencard process is still intact.
I don't think these arguments about smartness vs luck are going to help anyone.
If EB3-I folks feel that they are stuck too long and getting green is a very high priority item, they would want to move/port to EB2. A lot of people have EB2 portability with the approved 140 and all but many have chose not to go this route for various reasons.
Is that being smart or stupid?
Some people feel they don't want to change their jobs and set their careers back. Others are just plain inertial. Still others feel its risky jumping through all the hoops all over again.
I think if you are just being inertial you are being more stupid than smart but other than that its a matter of choice.
The visa retrogression relief will happen when it happens. IV's organized efforts can't be blamed.
If we don't fight, we will not even have a fighting chance.You join IV's organized effort but don't just stop doing your own thing. As pointed out by others, individual decisions are also important and will probably make more difference to you as an individual than the collective community.

EB-3 I wake up and send the letter out..we need to make relevant authorities aware of our situation. Uncertanity and doom stares us come on EB-3 I lets see some action!

How it be a decade, when your PD is 2001 or later? Even for EB-2, the wait time is 4-5 years.
Your letter should be based on facts and not on emotions (that, usually, tends to cloud the good judgment)

thats true, You will not get red marks. Coz, everybody agrees with that. It is just some good news and hope for EB2. Otherwise, people will be left with no option but to move back to their home country's in current markets.

I was not married to her when she got her green card.It is even more difficult if we wait for family based petition, so we decided to get it through EB3, which at that time the sched A was very much highlighted.I am also ff any ammendments offered but to our dismay,the battle is even more uphill.She works in ICU and she said that it is undeniably true that shortage of nurses is everywhere.Am sure our wives are also suffering just as bad.Hope none of the lawmakers have to wait in ER becasue the nurse who is suppose to look after her/him is still waiting for his visa. this American dream is just taking its toll on a lot of people.It is very frustrating.

He has asked the absent senators via staffers that if they do not want to come to hearings, they can leave this committee and let others take their place. Apparently they need atleast one democrat to proceed.

Also please call to the senators office and let them know your opinion. Please refer about the bill and convey your opinion according to the particular senator's voting on the amendment. This is very important coz this will greatly influence them and stimulate them for further similar amendments. Please dont delay. Let us heat up the issue. I would say to follow your attorney's advice though I don't think of any issues with going for premium processing as you are with the same employer. My friend has recently filed I-140 under regular processing and got approval within 2 1/2 months. Just make sure if your attorney submitted porting request while filing new I-140 under EB2. All the best.

Last week I went to Trenton with H1 extension receipt (original), letter from employer, but in vain. They need approved docs. Luckily this week I got the H1 extended and today I carried the original approved H1 I-797A and got the DL extended. I got only 2 years H1/DL extension after 6 year completion with I-140 approved and 485 in progress. Fyi

We applied I-485 in july and still waiting for receipt number. Also My wifes H4 visa expires on July 30 and her I-539 is pending. Can we use GC pending status to get driving license by showing the EAC receipt number ???
