I am on L1 visa since May 10, and have plans to switch to H1 without going back to India. My employer is not ready to provide experience and relieving letters, if I dont resign and I cant resign, since I need to pay 5000$.
1) So, does it make a problem while applying for GC, If I dont have these letters from present employer.
2) Inlcuding present company's experience only , I will be able to qualify for EB2 category. But I will not be having letters from my present employer to show that I am having 5 years experience.
Is it must to have experience and reliving letters from all my employers? What are the options for me now? :confused:

My PERM job description has requirement for Bachelor degree + 4 years experience. It is clearly specified in the PERM and ads that for every missing year towards 4 year bachelor degree, 1 year of experience would be accepted.
My PERM is approved. In the new I-140 form effective 11/23/2010, for EB3, it clearly asks to select either e) Professional or f) Skilled worker.
My understanding is Professional category can be chosen when the candidate has straight 4 year degree. In my case, I will be meeting the bachelor degree requirement with 3 year degree + 1 year experience. In this case, my belief is Skilled worker category should be chosen. Please let know if my understanding is correct.

hi,
I have approved labor & I-140 with my employer and they filed for my H1B extension. If i would like to change the employer, what is the process i should go through with new employer regarding my GC? will they have to apply labor again for me or can they use this approved labor & I-140 and continue my GC from then so that i will not lose my priority date? If they cannot use my labor, is there any other way to use my priority date.Please advise on how to proceed...

The big news today was Senator Reid now backtracking and promising climate change legislation before immigration reform. I got my 140 approved.Is there any deadline date like with in 90 days i have to apply for 485 or else it will expire.I am single so i dont want to get in to any trouble by applying for 485.

This is the scenario:
1. Husband becomes a LPR this year.
2. Wife still undocumented.
3. Wife was working long time ago, but became a housewife for the past 6 years, so no work.
How would the wife adjust her status under the new CIR if she was not working for the past 6 years?
Would she have to wait until the husband is able to petition her through other regular means?
Any ideas or is it too early to tell how USCIS will issue it's regulations about CIR?

Is there any way to know if 140 revoked after approval.is there any change in LUD ?
Put the reciept # in the USCIS online case status, if you see a LUD, check the case status, you might be able to see the "new text/info"
