Dear fellow 'immigrants stuck in process' from MD,
I suggest that we all get together to discuss how we can help the effort that immigration voice has undertaken. I did attend an IV meeting in NoVa a few weeks ago, I am keen on pushing an initiative of meeting periodically to discuss how we can collectively help our cause on this side of the river.
Send me an PM to express your interest and I will send out an email with further information.
If the MD state chapter is already having meetings, please ignore this message; but some one please send me the information on when these meetings take place.
Also let me know what you all think of this proposal?

My 7th year H1-B renewal was mailed by my lawyer on March 30th to the Vermont Serice Center. They received it on March 31st. I know that there was a change in filing taking effect April 1st. What happened in my case is that the USCIS forwarded my files to the California Service Center without receipting it first. California reveiced my file on April 4th and now I find myself out of status. My lawyer tries to tell me that it was an USCIS mistake whereas a lawyers who I retained for a second opinion tells me it was the mistake of the first attorney. I did everything possible for the to reconsider their decision but I still would like to know who's to blame. If it was indeed the lawyera mistake I'm considering filing a complaint against him.

I and my wife are on h1. I want to come on her h4. She recently applied for h1 extension as her employer is nonprofit org and has some policies of his own, he files every year. She filled in may�09 and got receipt number, as the case is still pending who we can apply for h4 now. Is there any way around to apply for my h4 while the case is still pending?
You can file your H-4 based on the H-1b receipt of your spouse, this is not a problem. They will approve your H-4 for the same duration as your spouses H-1, you will get an approval of H-4 only after your spouses H-1 is approved.

The answer depends on how far you have got in the permanent residence process. If the I-140 is approved and the 485 has been pending for 180 days, you can change employers if the new position is in the "same or similar occupational classification" as the one on the labor cert/I-140.

Hi,
I am on the 8th year of my H1B. I have an approved I140. There is a chance that I may have to leave my current job, and there will be a gap before I obtain another job. Two questions:
1. Can I stay in the US just on an approved I140 and no H1B?
2. I know I can get my H1b transferred. Can I instead leave my current job, be on I140 for some time, and apply for a new H1B for the new job, still continuing the 8th year?

Keep new approved H1 and all related documents with you for POE, also EVL.
I enered POE twice in similar situation as yours without new stamping.
Both times POE (Atlanta) experience was good for me.
I just entered even after new USCIS memo.

You can walk out of Wipro paying them nothing,
Have you signed any document or bond which is valid here in United states, then you might have to consult the lawyer otherwise if it is very staight froward case,
One sided bonds not going to last long in court,

Hi,
I was on F1 visa and graduated with Masters degree in Electrical Engineering on Aug22,2008 and had applied for OPT with a start date of Aug25, 2008. But my OPT application was rejected on Sep26 as I had already filed for H1-b(in general quota) and my H1-b was starting from Oct1,2008.
Now I am on H1-b and intend to do an second masters degree. I know that OPT is given only once for one level of degree.
Will I be eligible to get OPT for my Second Masters Degree ?
Also I am on H1-b visa for 6 months now and intend to go to F1 starting August, 2009. Will I be eligible to file for H1-b after my second Masters Degree ?
