Hello Attorney,
I have 6 months left on my H1B-I797 to expire. My visa on the passport got expired in 2007. I am planning to go to Tijuana, Mexico for stamping. I work for a financial company for past 4 years. I have approved I140.
Can you please advise if i can get the visa stamped? I have to visit India in May and hence cannot wait until the my H1B extension is filed and approved (based on my approved I140).
I am confused and worried that the consular officer may say that you have less than 6 months of validity on I797 and may deny the visa.
Can any one please advise?

Can someone give me the site where i can get the current processing dates for PERM?
The Labour certification is going to be filed this month end, in that case how long i have to wait to file I140?
Also i heared that I140 and 485 can be filed together.
Is that true? if so what is required from my side to the attorney for those two stages.

What is the deal with swift? I can render a scene with 6400 polygons, and
when I try to render one with only 390 I run out of memory!
No the shape is not more complex, in fact it is almost the same scene as the
6400 only minus many of the squares. Thats all that is in the scene squares, cant render squares with out what 200+ megs of ram. Im on a G4 any advice!

I am in H1B visa (valid until 10/2011), my wife is in F1 student (valid until 8/2011). We just got married 1 month ago in US. currently, we are staying in US. Now, she would like to stop studying for some reasons. To keep her valid stay in US, I have to transfer her f1 to h4. Could you please let me know step by step what I should do, what form I should take…etc.
Does she need any visa interview after filing the transferring f1 to H4?
Can she inform the school that she will stop studying right after filing visa transferring? (the school will stop her f1 if they know that).

The U.S. Department of State (DOS) reports that no later than April 30, 2010, all non-immigrant visa applicants worldwide will be required to use web-based form DS-160. The DS-160 form will combine the previous forms DS-156 and DS-157 and 158. Since not all U.S. Embassy’s and U.S. Consulates have implemented form DS-160, all consular posts that are not currently utilizing the DS-160 Web-based form will eventually be instructed to implement the DS-160 between March 1, and April 30, 2010. If H1B extension gets denied and my employer will appeal it. My questions are
1. Can I allowed to work until I decision is made on appeal?
2. If appeal is denied, from when I will be consider as out of status? (from I-94 expiry date or appeal decision date)
3. After appeal denial what is the grace period to leave the US?
4. Can same employer is allow to file another H1 petition for me?

My wife's finger printing fee was rejected last month even though we sent the correct fee. We sent the fee again.
But in the mean while, we also recieved our finger printing notices. Does anyone know as when we would get our EADs ?

My I-140 was submitted to USCIS in June, 2006 and got approved in August, 2006 and my employer has received the approval notice. I am checking the case status online but it is still showing up that my case is in pending till date. One of my friends is also in the same situation, his I-140 got approved recently and he received approval notice copy from attroney but the case did not update on the USCIS web site as approved. When I called USCIS, they told me that this needs to be reported by my lawyer and not me. When I talked to my attroney on this, she told me that we don't need to worry about this as the approval notice is available with us. But if the case update showing up correctly, atleast I could show that as a proof for my priority date portability if I switch the employer. Does anyone experienced the same problem and appreciate the suggestion as to how this can be corrected. Thanks in advance.

what if the non protonc is also denied. My case is also the same, applied non protonc but that got also denied.
